Rumors of Judge Duval’s retirement are a bit premature

A reader emailed us Troy Johnson’s heartfelt farewell to Judge Stanwood Duval that ran in the Houma Courier website that a Slabbed reader was kind enough to email in for clarification.

Judge Duval took senior status last December so while he is semi retired he remains on the bench albeit at a reduced workload.

My own opinion is that if I were a policyholder going to court in NOLA he’d be one of the judges I’d want on my case, not because he favors policyholders but because he believes the law applies equally to all the parties in his courtroom.

While Troy was a bit early in wishing the judge well his synopysis of Judge Duval’s career still makes his letter worth the read.

    Howdee,
    I spoke to Nikki Buskey of the Houma Courier this morning about the Good Judge, and this LTE regarding his retirement. She will get to the bottom of it. They rock you know.
    You have to admit though, MRGO would be a hell of a last hoorah!
    As he is from Houma, perchance she could do a profile, axed Editilla? I know I would love to know all sorts of stuff about this man and his relationship to The Law and Louisiana all of it. Cajun boy, like Herolero Russel Honore.

    I of course hipped the young gum’shoe to the slabbernation for copious detailing of his heroic efforts to keep it all in the light of day for da’Peoples effected by MRGO.

    I hope he writes a book.
    I hope he comes over to our side of the levee before the next one fails.

    And I totally disagree with this “slobbering love affair” regarding Stanwood R. Duval, Jr. His rulings in KATRINA cases, with the exception of the insurance decision, which the Fifth “Circus” reversed, have not benefited innocent “Victims of KATRINA” at all. Arguably, even his insurance decision (reversed by the Fifth “Circus”) was calculated to benefit His “Dis-Honor’s” close personal friend of long-standing, plaintiffs’ lawyer Calvin Fayard, who Judge Duval annointed as Plaintiffs’ Liason Counsel in the insurance category of KATRINA cases. I predict that Judge Duval will be ruling in favor of Fayard’s clients in the Robinson/MRGO case, which unfortunately will not benefit people who lived West of the Industrial Canal, but will be reversed by the Fifth “Circus”, the SCOTUS, or both. In my humble opinion, Judge Duval, Fayard and those of their ilk have irreparably CORRUPTED the integrity of the “Victims of KATRINA” litigation, and belong in jail. For anyone who cares to see my views on these subjects in further writing, they are public record in Civil Action No. 08-4728 on the docket of the United States District Court for the Eastern District of Louisiana. As a result of my making allegations of corruption and misconduct against Judge Duval, Fayard and others, I have been disbarred, disgraced, embarrassed and humiliated. However, nothing has happened to Judge Duval or to Fayard, whose evil-doing continues. It makes me physically ill for seemingly intelligent people to praise people like Stanwood R. Duval, Jr., who belongs behind bars.

    Sop, thanks for clarifying the ‘leaving the bench’ – ‘announced retirement’ issue brought to light by Troy Johnson’s LTE. I was scarred he might leave before making all of his Katrina litigation decisions. I know I wouldn’t want to be in his position.

    Regarding the Judge’s decision on USACE immunity west of IHNC, is that decision being appealed? Will that appeal reach the US Supreme Court? Anyone know?

    I think Ashton filed a writ of cert on that issue with the Supremes. Perhaps if he sees this he can clarify for us.

    To Crescent City Ray and Other Readers of Slabbed: To answer your question directly, it’s “strange”, but he has NEVER rendered a final appealable Judgment on his determination that the United States of America was immune with respect to the Outfall Canals, ie. 17th Street, Orleans Avenue and London Avenue. It is my recollection that his Order and Reasons on this very important subject was rendered in early 2008. This is VERY odd. Additionally, the Plaintiffs’ Liason Committee, which filed a motion for reconsideration has never sought to have that motion heard, ie. noticed for hearing; nor have they requested that a final appealable Judgment be entered on this Order and Reasons. STRANGE, ODD and WAY BEYOND STRANGE and ODD. A Petition for a Writ of Certiorari on the dismissal of the claims against the contractors and engineers, rendered by the Fifth “Circus” on 4/30/09, regarding the Outfall Canals is due for filing on 8/30/09. The Plaintiffs’ Liason Committee has already announced that they are not going to do anything, but I am! I’m telling all of you, THIS IS WAY BEYOND STRANGE AND ODD.

    Wait a minute! I must have had too much to drink tonight (I only started drinking today @ 0630 hours!). The “answer” is perfectly obvious: The #@$%%## isn’t going to render any opinion which might fuck up what he plans to do for his “close personal friend of long-standing”, Calvin Fayard, in the Robinson case. I repeat: This SOB belongs in jail, along with many others. “Champion of the Victims of KATRINA” my ass! AROD. cc: The FBI.

    Judge Duval’s Katrina decisions for the most part have not been very good for homeowners. While his Canal Breaches opinion was well thought out and well written as per La. law, his resolution of other legal issues such as “offset for flood payments” has been void of any real legal analysis.

    While I would certainly like him, Judge Fallon or Judge Barbier over the rest of the rogue’s gallery on Camp St., he certainly has not been the liberal equivalent of Judge Englehardt. Then again, Judge Englehardt is certainly one of a kind.

    CORRECTION: That Petition for a Writ of Certiorari is due in the Supreme Court on 7/30/09, not 8/30/09. Sorry. Don’t be “mis-led” by my prior Comment. WHERE IS THE GODDAMNED FBI? P.S. to NRB: I’ve made enough enemies since KATRINA, but I respectfully disagree with your conclusion that “…his (Duval-Daley-Fayard’s) Canal Breaches opinion was well thought out and well written.” The man is not as smart as his wife (also his law clerk) tells him he is. He also is CORRUPT, in my judgment. Ask SOP and nowdoucit to post my Complaint against Duval and others in Civil Action No. 08-4728. I also invite you to read my briefs and listen to oral argument in the Fifth “Circus” in Case No. 07-30706, which is the Outfall Canal case which dismissed all claims against the contractors and engineers, a travesty of justice if there ever was one, and one in a long line of travesties from Section “K”. Now let’s see how he “takes care of” his close personal friend of long-standing, Calvin Fayard, in Robinson. WHERE IS THE GODDAMNED FBI?
